CPS drops the case of assault by flying sausage

A bizarre case of assault by sausage has been dropped after a judge said that prosecuting could affect the dignity of his court and the prosecution process itself.

Candice Whybrow, 24, from Waltham Abbey, suffered retinal bleeding and permanent damage to the back of her left eye during a food fight at a party in September 2009.

Ashly Brearey, 22, from Harlow, was charged with assault causing actual bodily harm after the incident at his home, but denied the offence.

Judge Anthony Goldstaub QC queried whether there was a realistic prospect of conviction at Chelmsford crown court, saying: "The case is stale - if not the sausage."

The Crown Prosecution Service dropped the case yesterday. It formally offered no evidence and Mr Brearey was found not guilty.
