Arrested pilot under alcohol limit

12 April 2012

A passenger jet co-pilot who was arrested on suspicion of being over the legal alcohol limit will face no charges, Virgin Atlantic said.

The results of a blood test showed that the pilot was under the legal alcohol limit for aviation workers, the airline said.

Police arrested the 42-year-old first officer on the Virgin Atlantic Airbus A340-600 at 11.16am on October 28, shortly before it was due to take off.

The 266 passengers on the flight from Heathrow Airport to Miami were delayed for three and a half hours.

In keeping with airline policy, all members of the three-man flight deck were replaced following the arrest.

In a statement, Virgin Atlantic said: "The results showed that the pilot, who was a relief pilot on flight VS5 between London Heathrow and Miami, was under the legal alcohol limit for aviation workers as set out in the Railways and Transport Safety Act 2003 and therefore, as no offence was committed, no charges will be brought.

"The pilot is now expected to resume his duties at the airline."

Following his arrest, police had released the pilot on bail but he was suspended from duty pending the police investigation, the airline said.

Airline regulations, in accordance with transport law, recommend flight crews drink no alcohol for at least eight hours before flying.
