A New York couple have claimed in a lawsuit that the wife gave birth to someone else's babies following an IVF mix-up by a California fertility clinic, according to reports.

The Queens couple, who are Asian, last week filed a federal lawsuit after the woman claimed she gave birth to two non-Asian babies.

According to the lawsuit, the two babies were also not related to each other and instead were a genetic match to different clients at the same fertility clinic.

The couple were forced to give up the babies to their respective genetic parents, according to the New York Post.

The couple, known only as A P and Y Z in court documents, said they spent $100,000 (£80,000) on clinic fees and travel costs.

Court documents show the IVF clinic collected the sperm and eggs from Y Z and A P in early 2018 and formed five embryos, four of which were female.

After one failed attempt, the couple were “ecstatic” to learn A P was pregnant with twins in September 2018.

They later learned that both babies were boys but the “confused” couple were told the sonogram tests that indicated the babies' sex were not accurate or definitive. A P later gave birth to twin boys, neither of whom were Asian.

DNA testing found the boys did not share genetic material with A P, Y Z or each other.

Court documents show the couple still do not know what happened to their two embryos that were supposed to be implanted into A P.

The lawsuit states the plaintiffs have suffered physical and emotional harm and accuses the defendants of 14 counts, including medical malpractice and negligence.
